​General Terms and Conditions for Customers

These General Terms and Conditions for Customers apply to all purchases and interactions between Malbelle Trading LLC ("Malbelle") and the customers using our platform.

Definitions

Offer: The selection of fashion and lifestyle products made available for purchase on the Malbelle Platform.

Order: A request placed by a Customer to purchase products from Malbelle via the Platform.

Customer: Any natural or legal person placing an Order through the Platform.

Agreement: A contract between the Customer and Malbelle concerning the purchase and delivery of an Order.

Platform: The website, mobile application, or other digital tools operated by Malbelle for offering and processing Orders.

Applicability

1. These Terms apply to all orders placed through Malbelle.com or associated apps.
2. By placing an Order, the Customer agrees to these Terms and enters a direct contractual relationship with Malbelle.
3. Malbelle reserves the right to amend these Terms at any time. The version applicable at the time of Order will apply.

The Offer

1. Malbelle endeavors to present all product details, including sizes, materials, prices (inclusive of VAT), and imagery, as accurately as possible.
2. Despite best efforts, errors in the Offer may occasionally occur. Malbelle reserves the right to correct any inaccuracies.
3. Availability of products is not guaranteed and is subject to stock levels.

The Agreement

1. The Agreement becomes binding once the Customer confirms their Order by completing checkout on the Platform.
2. Malbelle will confirm the Order via email or notification. In the absence of such confirmation, the Agreement is not binding.
3. The Customer is responsible for providing accurate shipping and contact information.
4. If home delivery is chosen, the Customer must be present at the delivery location. Failed deliveries due to incorrect details may result in additional charges.
5. Shipping charges, if any, will be clearly mentioned before Order confirmation.

Cancellations and Returns

1. Customers may cancel an Order only before it has been processed or shipped. Once shipped, cancellation is no longer possible.
2. Malbelle offers a 7-day return policy from the date of delivery, provided items are unused, in original packaging, and with all tags attached.
3. Returns must be initiated through our Platform or by contacting customer service.
4. Certain products such as intimate wear or customized items are not eligible for return or exchange.
5. Refunds will be processed within 10 working days from the date the returned product is received and inspected.

Payments

1. Payment must be completed at checkout via the provided online payment methods.
2. In select cases, Cash on Delivery may be available based on location and order value.
3. Malbelle uses secure payment gateways to ensure customer data protection.
4. Refunds for valid returns or failed deliveries will be credited to the original payment method or as store credit, based on customer preference.

Complaints and Dispute Resolution

1. Complaints relating to products, delivery, or service should be submitted via email or contact form.
2. Malbelle aims to acknowledge all complaints within 2 business days and resolve them within 7 business days.
3. If a resolution cannot be achieved, disputes may be escalated to consumer protection authorities in the UAE.

Personal Data and Privacy

1. Malbelle processes customer data in accordance with the UAE data protection laws and its Privacy Policy.
2. By using the Platform, the Customer consents to the collection and use of personal data as outlined in our [Privacy Policy].

Limitation of Liability

1. Malbelle shall not be liable for any indirect, incidental, or consequential damages arising from the use of or inability to use the Platform.
2. Liability for any product-related issue is limited to the value of the product purchased.
